More horror in Romanian shelters for strays : RAMNICU VALCEA...

Dear friends,

I think that the horror news from Romania do not surprise anybody, anymore, unfortunately.

Again, we face another death camp for stray dogs - in Ramnicu-Valcea Romania, but also the hostile attitude , openly CRUEL, of the local administration. Although the euthanasia of healthy animals is BANNED in Romania, by the law IN FORCE, it appears that the Mayor of Ramnicu Valcea, decided to make his own laws in his city , willing to " euthanise" strays after 7 days of being in the shelter( of the most miserable life possible ).From the text of the bilingual letter, you will be able to realize the barbaric intenstions of the local councils and the administration of the shelter. We, citizens from Romania and around the world, are completely OUTRAGED regarding the HORRIBLE conditions in which the dogs are kept in the shelter from FETENI which belongs to the Ramnicu-Valcea Town Hall.
Noi, cetateni din Romania si din lumea intreaga suntem oripilati de conditiile ORIBILE in care traiesc cainii in adapostul din FETENI - administrat de Primaria Ramnicu-Valcea.

In the civilized world, ALL public shelters for stray or abandoned animals ( dogs and cats ) are OPEN TO THE PUBLIC every day of the week....at least 6 hours, from noon until late evening, including the week-end, so people can go and adopt, without ANY written permission from any town hall . Every day, volunteers are not only welcomed BUT asked to assist the employees in their activies in the shelters. Photos of all the animals are posted on social media network to facilitate their adoption. NONE OF THIS HAPPENS in Ramnicu-Valcea - quite the contrary . WHY ?
In lumea civilizata, toate adaposturile pentru animale fara stapan sau abandonate sunt DESCHISE PUBLICULUI, cel putin 6 ore pe zi, in fiecare zi a saptamanii ( atentie - Sambata si Duminica inclusiv) de la orele 12 pana seara, pentru a facilita accesul tuturor celor interesati sa dopte, FARA nici un fel de aprobare scrisa de la NICI O PRIMARIE. Voluntarii sunt nu numai foarte bineveniti, dar sa fac apeluri pentru participarea lor in toate activitatile din adaposturi. Fotografii ale animalelor din adaposturi sunt postate peste tot in Social Media, pentru a le facilita adoptia. TOATE ACEASTEA SUNT INTERZISE la Ramnicu-Valcea. DE CE ?

We also found out with disbelief, that the Mayor, Mr.Francu does not YET understand his own country's legislation, regarding the animals, and we, have to remind him this : Am aflat, cu stupoare, ca dl.primar Francu nu cunoaste INCA legislatia in VIGOARE in propria lui tara, ca atare trebuie sa i-o facem cunoscuta

1. Conform art.7¹ din Legea 205/2004 privind protectia animalelor, cu modificarile si completarile ulterioare : „Este interzisă eutanasierea câinilor, a pisicilor şi a altor animale, cu excepţia animalelor cu boli incurabile, constatate de medicul veterinar”
Deci, nu se eutanasiază decat animalele cu boli incurabile, nu cele sanătoase, şi numai pe baza unor diagnostice precise (proba bolilor incurabile) şi incontestabile.

We ask that Mr.Mayor and the local council start implementing in Ramnicu-Valcea the best method to diminish the stray dogs over population : Capture/Sterilize/Return in the territory....and also to fully colaborate with the local organizations for the protection of animals, to OPEN the shelter to the public, to let volunteers participate every day for at least 6 hours in the activies in the shelter, to promote adoptions . We also ask that those employees which are cruel and brutal with the animals to be immediately replaced with people who understand that animals are living creatures who feel pain, who must be treated humanely
Rugam pe dl primar si consiliul local sa inceapa implementarea singurului program care a dat roade in toata lumea in privinta diminuarii numarului de animale fara stapan : Capturare/Sterilizare/Rturnarea in teritoriul de unde au fost capturati : sa deschida adapostul pentru public, sa lase voluntarii sa participe la toate activitatile din adapost cel putin 6 ore pe zi. De asemenea solicitam inlocuirea angajatilor care trateaza animalele cu brutalitate si cruzime cu persoane care inteleg ca si animalele simt durere fizica si trebuie tratate cu compasiune .

WE hope that the situation in the shelter of Feteni will improve immediately, that the Mayor of Ramnicu Valcea will renounce the idea to illegally kill animals and will fully colaborate with the well intened people from the local associations and abroad who want to assist in solving the problme with civility, moral, ethic, compassion , like in all civilized countries in the 21st century. Speram ca situatia animalelor in adapostul din Feteni sa va imbunatati imediat , ca domnul primar din Ramnicu-Valcea va renunta la idea de a ucide in mod ILEGAL animalele si va colabora deplin cu oamenii de buna credinta din localitatae ( mai ales asociatiile pentru protectia animalelor ) si din strainatate pentru a rezolva aceasta problema in mod civilizat, moral, etic, compasionat ca in toate tarile civilizate in secolul 21.

Please be so kind and sign and share this petition....Thank you .More mass poisonings of stray animals in PLOIESTI - Prahova County Romania...Please sign and share....Strangely enough "squads" of dog catchers work NIGHT SHIFTS lately ( in many cities ) picking up dogs, who of course disappear and possibly placing poison....There are lots of emails for authorities in Romania in the petition setting...Thank you ...Yes, they want tourists...they "clean up " the streets...they massacre animals, as usual...
I want to remind you that in the same PRAHOVA COUNTY - Capital city PLOIESTI, they round up stray dogs, dump them in BUCOV shelter form where they VANISH ( those who did not vanish before , during their capture by the dog catchers, who, as usual , as everywhere in Romania are hired to TORTURE and KILL ...the lowest sub humans ever ....and the same county where the NOTORIOUS  " doctor death " Emilia Herescu has already KILLED with her own hands thousands and thousands of dogs, in her shelter in BOLDESTI SCAIENI...This is a HORRIBLE COUNTY....actually, very few counties in Romania can say that they do not MASSACRE animals...maybe one - SIBIU - for the rest....the SUMMER "clean-up" has begun...

We are OUTRAGED by the decision of local authorities from Sfantu Gheorghe - Covasna Couny - to KILL all stray dogs and cats in town, based on the fact that a fox with "rabies" has been discovered. 
It is appalling to find out that the norms and laws in FORCE in Romania, are continuously BROKEN by the very authorities which are supposed to apply them. 
For a very long time, Romania has gained a horrible image in the entire world, because the despicable treatment of animals. 
We consider this decision - TO KILL ALL STRAY ANIMALS in Sfantu Gheorghe - OUTRAGEOUS- BARBARIC - and - DESPICABLE and we will also inform the EU about the fact that there are animals with "rabies", that you decide to order a real MASSACRE and that local authorities decided to break the laws. 
It is absolutely OUTRAGEOUS to make the local Police to run after the animals, to shoot them with tranquilizers, to harass people... 
It has come to our attention that the substances to be used to catch and KILL these animals have been bought from the Veterinarian KONDOR, whose wife works as a City Councilor... 
Please, reverse this horrible intention and make sure that all the laws and norms regarding the issues of rabies are applied and NO ANIMAL WILL BE KILLED from now on.

Va rugam sa renuntati imediat la intentia de a UCIDE IN MASA, animale in Municipiul Sfantu Gheorghe asa cum a ordonat directorul DVS Covasna, dr. Siko Barabasi Sandor( "‘Vor fi două zone de protecţie, una pe o rază de trei kilometri în jurul focarului, unde toate carnasierele nevaccinate antirabic, câini, pisici, vulpi, lupi, jderi, etc, vor fi ucise, aşa cum scrie legea (…), iar pe o rază de zece kilometri se va institui o zonă de supraveghere cu ajutorul proprietarilor care vor trebui să ţină sub observaţie animalele şi să raporteze dacă observă tulburări, dacă sunt agitate fără motiv, sunt agresive sau nu beau apă’, a spus dr. Siko. - DSV Covasna, dr. Siko Barabasi Sandor) deoarece aceasta decizie este in totala contradictie cu normele si legile IN VIGOARE IN ROMANIA. 
VA rugam sa dispuneti IMEDIAT investigarea felul in care DVS COVASNA ia hotarari care incalca legile, si toate celelalte actiuni legale de aceasta INTENTIE CRIMINALA - inclusiv cumpararea de substante tranchilizante sau letale de la Dr.KONDOR a carui sotie este consilier la Primaria Municipiului Sfantu Gheorghe... 
Va rugam sa dati IMEDIAT CURS plangerilor penale depuse impotriva DVS Covasna si a Primariei Sfantul Gheorghe, de catre organizatii pentru Protectia Animalelor din Romania 

Va rugam sa INTERZICETI IMEDIAT MASACRAREA ANIMALELOR> 
Orice actiune de ucidere a animalelor ( salbatice sau domestice - cu sau fara stapan ) in Municipiul Sfantu Gheorghe va aduce prejudicii IMENSE imaginii Romaniei in lume. 

Va rugam dispuneti sanctionarea celor care au incalcat legile si atentionarea lor, prentru asemenea decizii care pot duce la UCIDEREA IN MASA a animalelor sa NU mai fie luate niciodata. 
Totodata DSVSA Covasna a eutanasiat in mod ilegal un pui de vulpe care nu prezenta semne clinice de rabie. 
Contrar celor dispuse de catre DSVSA Covasna, Ordinul presedintelui ANSVSA nr. 29 din 28 martie 2008 pentru aprobarea Normei sanitare veterinare privind măsurile generale de prevenire şi control al rabiei la animale domestice şi sălbatice prevede ca eutanasierea animalelor salbatice se face doar in situatia in care acestea prezinta semne clinice de rabie. 
Totodata, avertizam ca, potrivit legii, Politia Locala nu are competenta de a captura prin tranchilizare cainii si pisicile aflate pe domeniul public. Atributia capturarii cainilor apartine serviciilor de gestionare a cainilor fara stapan iar tranchilizarea cainilor se poate face doar sub supravegherea unui medic veterinar si doar in cazul exemplarelor foarte agresive, aflate in locuri inaccesibile sau suspecte de a fi turbate. 
In ceea ce priveste pisicile, capturarea acestora nu se poate face prin impuscare cu tranchilizante intrucat aceasta metoda provoaca ranirea (chiar si mortala) a acestor animale. 
Ii facem respunzatori de viata animalelor din Sfantu Gheorghe pe dl.Director DVS Covasna dr. Siko Barabasi Sandor, primaria Sfantul Gheorghe si Consiliul Judetean Covasna

Adopted! Romanian Constitution FORBIDS the bad treatments against animals



Some months ago FNPA (National Federation for Animal Protection) started doing demarches for introduction in the Romanian Constitution an article regarding the animal protection. Our proposal was:


"since animals are sentient beings who perceive physical and mental suffering, the State and the citizens have to ensure the right to life of animals, respect for animals and their dignity, taking the necessary measures to protect them."



accompanied by a comprehensive material by what we were bringing constitutional arguments of need of Constitutional regulation but also examples of countries whose Constitutions or penal codes contain provisions regarding the protection of animals.

We started this campaign by accepting the experience of other countries which, despite major campaigns have failed to include provisions on the animal protection but especially taking into account the context of Romania where the authorities are hostile to animals.

Our amendment was officially appropriated by a deputy but also by Constitutional Forum - a body of civil society, citizens, universities and the only one who can take part in the Constitution Review Commission.
The amendment raised the longest debate starting from "right to life of animals" that induced fear that with the adoption of the text all slaughterhouses have to be closed!!
The amendment was rejected!



Although almost no hope the rejected subjects to be resumed, however we continued demarches by proposing a new formulation. Today it has been discussed. After another debate on the text, the adopted form, unanimously, was:

"The bad treatments against animals, defined according the law, are forbidden "

Romanian Constitution is the fundamental law of the Romanian state and establish the general principles of the State, the rights and duties of citizens and public authorities. No other law can violate any provision of the Constitution and all laws must be adapted accordingly. By this provision the animals have a constitutional right not to be bad treated!

It is a huge step that needs to help in adaptation / interpretation of laws regarding not only the pet animals but also to animals in laboratories, farms, zoos, circuses.
Romania, a country where animal cruelty is happening everywhere and permanently, where the authorities rather approve actions against animals, 
FORBID  BY CONSTITUTION the bad treatment towards animals.
Romania thus becomes one of the few countries where there is a constitutional regulation in this regard!

In September 2, in Romania, a child was killed by dogs. Too little mentioned, the 4 years old child was left too long unsupervised by his grandmother, so he came from a park, far away, on a private fenced land, where dogs were. The all televisions and newspapers is CONTINUOUS talking about this tragedy , do shows, stories , interview people who feel disturbed by dogs, show false statistics, distorts reality, inflamed the entire population. On the contrary, despite the pain, father and grandfather of the child were talked about the dogs like "they are also poor beings"; they don’t consider the dogs to be guilty but condemns the authorities because they did nothing for a correct management.

AUTHORITIES USE THIS TRAGEDY CLAIMING THE KILLING OF ALL DOGS! Yesterday, the Romanian President, Traian Basescu , urged the Government to elaborate an emergency ordinance that all dogs be killed. In parallel, President of the Chamber of Deputies asks for urgent draft legislation providing for killing dogs. For 20 years in Romania the dogs were tortured, captured and taken to “shelters” - extermination camps, where if they did not die of hunger and thirst they were killed by cruel methods. Hundreds of thousands of dogs died in the camps of the City halls, however huge amounts of tens of millions of Euros are „spent” (fictively) for „managing” the stray dogs. The problem was not solved in the street but even got worse because nowhere in the world the mass killing was a solution.

Although it has been shown both by the experience of other countries and own (Oradea) that sterilization of stray dogs is the only solution for the disappearance of stray dogs , the Romanian authorities have totally ignored it, insisting on a failure method! Why? Because killing dogs in Romania has became an industry, tens of millions of Euros " spent " for managing dogs actually went into the pockets of those involved . Killing does not solve the problem so in the street will always be dogs so the authorities will have permanent reasons for "spending" of public money.

The next week will be discussed the KILLING DOGS PROJECT!

Subject email/letter: STOP mass killing dogs! Adopt mass sterilization!

For the attention of the Romanian authorities:

We regret the tragedy of the child killed by dogs. Such dramas should not repeat. But if you insist in applying the same methods of dog mass murder that has been conducted in Romania for 20 years and that has not resolved the problem in the streets, this risk will remain permanent. We do not understand the interests of the Romanian authorities to continue or implement again a method that has proven over the world to be failed, expensive, but as well immoral, shameful. We do not understand why, despite all the evidence:

the benefits of dog sterilization

the results obtained in Oradea, where, by the Sterilisation and Return programme, the number of stray dogs decreased from 5000 to 300
the outcomes of the World Health Organisation’s study (undertaken between 1981 and 1988) concluding that “the euthanasia or incarceration programmes which are both inefficient and expensive”
the experiences of other countries that, after years of mass murder without effect, implemented mass sterilization laws having noticeable effects,
you do not accept to implement the only solution for managing the dogs, that is the sterilisation and return of the gentle and healthy stray dogs, compulsorilyaccompanied by the sterilization of dogs with owners that are the main source of street dogs by mass abandoning. Approximately 5 million puppies are born in Romania in rural areas every year, some of them being killed by their owners and the others being abandoned in the street. So long as the dogs with owners will not be sterilized, through coherent programmes, the streets will never be free of dogs.

We also remind you:

the Constitutional Court of Romania decided (Decision 1/2012) that euthanasia is ILLEGAL as a stray dogs management method until all other solutions have been applied properly, uniformly and with responsibility by local authorities
The Lisbon Treaty (art. 13, TFEU) states that the “animals are sentient beings”
the European Parliament Resolution of 4 July 2012 on the establishment of an EU legal framework for the protection of pets and stray animals ( 2012/2670 (RSP )

We ask you for an URGENT STERILIZATION & RETURN LAW OF ALL STRAY AND OWNED DOGS

Romania is already known by animal cruelty . Please, be advised that if the killing of dogs starts, we will show to the entire world the reality of the dog camps, we will notify worldwide about the financial interests behind the business of killing dogs, we will withdraw any support that we have given so far to your country, we will boycott Romanian products and tourism, as no one will want to associate with a corrupt, cruel and immoral country.

As most of you already know, the Constitutional Court decided on September 25 that the law regulating mass euthanasia is constitutional. By this decision the Constitutional Court has contradicted its own previous decision from January 2012 (whereby it regulated that euthanasia may be applied only as a last method, only after the authorities have applied all solutions, correspondingly, and such solutions had failed to reduce the number of the strays on the streets or to eradicate the strays situation).

The Constitutional Court has proved (together with the Parliament, Government and President) to lack verticality in favor of the abuse of power.

In the same day, the President has promulgated the law!

The dogs may now be put to sleep and the representatives of the NGOs are not allowed to even be present!
The Sanitary Veterinary National Authority and the Veterinary College – institutions which in any other country other than Romania fight and defend the welfare and life of the animals (in Romania these authorities act against the interests of the animals) – are not strangers to this situation. The Veterinary College has introduced in the law the fact that euthanasia must be done in compliance with the Euthanasia Code which was drafted and issued by the Veterinary College!

Thus dogs may be “euthanasied” with also carbon dioxide, carbon oxide, potassium chloride, nitrogen, electric shocks, penetrating capitive gun – cruel methods non-acceptable in EU

The Sanitary Veterinary National Authority has banned from the law the right of the NGOs to assist at the euthanasia of the dogs from the shelters!

This law which legalizes mass euthanasia of the dogs does not only severely breach the human dignity and the physical and psychological welfare of the Romanian citizens but any ethical and European norms regarding animal protection and management!

As you all know, this incredible war against the strays has been started by the case of the 4 year old boy, which was presumably killed by strays. From the moment the facts were presented in the way that Ionut was killed by 5 stray dogs, without any type of investigations, without any type of evidence, without any verified information. A large variety of essential arguments and evidences have appeared and they continue to appear, which clearly indicate that this case was willingly fabricated. However the press and media ignore them all!

Actions! What can still be done!
We intend to start claims with the European Court for Human Rights, Venice Commission, European Court of Justice, nonetheless all these procedures will take time and will not stop the massacre now!

We intend to start legal actions in Romania as well and to contest in court the legality of the Euthanasia Guide, however, these actions will take time as well, and the former experience and background clearly show that correctness and justice are not winnable in Romania.

All these procedures may have effects later on, nevertheless we need solutions NOW to stop the massacre! TODAY STARTS THE COUNTDOWN OF THE 14 DAYS!

For the moment, the only real chances of the dogs are your actions, the actions of the officials and authorities in your countries as well as the recommendations of the European Parliament and European Commission. Therefore, related requests and claims with these two European institutions are extremely necessary.

Romania breaches the European Convention for the Protection of Pet Animals ratified by Romania in 2004, namely Article 13 – “Exceptions to the principles laid down in this Convention for the capture, the keeping and the killing of stray animals may be made only if unavoidable in the framework of national disease control programmes”. In this respect, any citizen of the EU may file a COMPLAINT TO THE COMMISSION OF THE EUROPEAN COMMUNITIES concerning failure of Romania to comply with European law, thus of the Convention (you can download that form in your own language from the link: http://ec.europa.eu/eu_law/your_rights/your_rights_forms_en.htm)

Mass killing is simply not the answer and is totally unacceptable in the civilized world of today.

MASS NEUTERING is the only LONG TERM solution for the decrease of the stray dogs phenomenon, as it aims to the source of the problem.

Law 258/2013 regarding the mass euthanasia of the dogs is against the provisions of the European Convention ratified by Romania, it clearly contradicts the European norms regarding animal protection, it is contrary to all the conclusions of the studies performed by specialized institutions as the World Health Organization (WHO) that concluded that dog slaughter has no result on the dog population in the street, it is contrary to all conclusions and results deriving from the mass euthanasia and killings in Romania, it is contrary to all results obtained in Oradea, Lugoj, Cernavoda and in other countries where “catch, neuter and return” lead to the almost complete eradication of the strays situation.

The law regarding the mass euthanasia destroys morality, human dignity, it gravely affects the physical and psychological welfare of the society and it denies the constitutional right to physical and psychological integrity.

We ask the President, the Government, the Sanitary Veterinary National Authority, the City Halls to show morality, wisdom and common sense and to prevent the implementation of a monstrous law, not dignified for the present century and which will not lead to the resolving of the problem.

We ask the European Commission, European Parliament to have a decisive and strong position and to make use of any legislative possibilities in order to stop the massacre of the dogs in Romania.

In case the authorities in Romania persist in abusing their power like the Constitutional Court has done by adopting a decision contrary to its previous decision, persist in pursuing reprehensible decisions, persist in demonstrating brutal and immoral behavior, continue to apply aggressive and corrupt actions, all part of a program for implementing a horrible massacre and which is in contradiction with the civilization degree which Europe has reached, WE REQUEST THAT ROMANIA IS EXCLUDED FROM THE EUROPEAN UNION!

Liebe Tierfreunde,

so wie die Mehrheit unter Ihnen weiß, hat das Verfassungsgericht am 25. September entschieden, dass das Gesetz der Massentötung verfassungsgerecht ist. Durch diese Entscheidung hat das Verfassungsgericht Rumäniens die eigene Entscheidung vom Januar 2012 ( worin bestimmt wurde, dass die Euthanasie nur als letzte Lösung angewandt werden kann, nur nachdem von den örtlichen Behörden alle Lösungen entsprechend angewandt wurden und nicht zur Verringerung der Hundeanzahl oder zur Beendung des Phänomens geführt haben) widersprochen.

Das Verfassungsgericht hat somit (neben dem Parlament, der Regierung, dem Präsidenten) das Fehlen der Aufrichtigkeit und die des Machtmissbrauchs bewiesen.

Am selben Tag hat der Präsident Rumäniens das Gesetz unterschrieben und in Kraft treten lassen!

Die Hunde können auf jeden Fall getötet werden, während die Vertreter der Nichtregierungsorganisationen (NRO) kein Recht haben zugegen zu sein!
Die Nationale Tiermedizinische Behörde und das Kollegium der Tierärzte – Institutionen die in jedem Land außer Rumänien für das Wohlergehen und das Leben der Tiere kämpfen und nicht gegen sie – haben zugestimmt.
Das Kollegium der Tierärzte hat in das Gesetz die Vorgabe eingebracht, dass die Tötung nicht mehr allein durch die in der Europäischen Union akzeptierte Einschläferung (Vollnarkose und danach Todesspritze) durchgeführt wird, sondern sich den Richtlinien des rumänischen Kollegiums der Tierärzte (einer Art Tierärztekammer) zu folgen hat. Das bedeutet: Die Hunde dürfen mit Kohlendioxiden, Kohlenoxiden, Kaliumchloriden, Stickstoff, Stromschlägen/ Elektroschock, Bolzenschüssen „euthanasiert“ werden, grausamen und qualvollen Tötungsmethoden, die dem Begriff der Euthanasie widersprechen.

Die Nationale Tiermedizinische Behörde hat durch das Gesetz das Recht der unabhängigen Tierschutzorganisationen beseitigt, bei der Euthanasie der Hunde in der Verwahrung anwesend zu sein!

Somit verletzt dieses Gesetz, welches die Massentötung der Hunde legalisiert, nicht nur die menschliche Würde und das psychische und physische Wohlbefinden der rumänischen Zivilgesellschaft, sondern auch jede ethische und europäische Norm hinsichtlich des Schutzes und der Tierhaltung!

So wie Sie wissen wurde dieser unglaubliche Krieg gegen die herrenlosen Hunde durch den Fall des 4-jährigen Knaben, Ionut, unter der Annahme dass er von herrenlosen Hunden ermordet wurde, ausgelöst. Seit der sofortigen Entscheidung, dass Ionut von 5 herrenlosen Hunden, ohne Nachforschungen, ohne Beweise, ohne Informationen getötet wurde, sind inzwischen eine Menge von Beweisen zum Vorschein gekommen und weiterhin erscheinen, dass dieser Fall zurechtgebastelt wurde, wobei die Presse alles ignoriert!

Aktionen! Was kann man tun!

Wir beabsichtigen Aktionen beim Europäischen Gerichtshof für Menschenrechte, der Kommission in Venedig, dem Gerichtshof der Europäischen Union zu unternehmen, aber diese werden dauern, also werden Sie das Massaker nicht jetzt stoppen!

Wir beabsichtigenden den Start von legalen Aktionen auch in Rumänien, sowie Widersprüche bei der Instanz der Leitung der Euthanasie, aber auch die werden dauern, während die Erfahrung beweist, dass die Korrektheit und das Recht in Rumänien nicht zu haben sind

Aber die haben späte Wirkungen, während wir JETZT Lösungen finden müssen um das Massaker aufzuhalten! Ab heute beginnt das Zählen der 14 Tage!

Im Augenblick, die einzigen Chancen der Hunde sind Ihr Druck, der Vertreter Ihrer Länder und die Verfügungen des Europaparlaments und der Europäischen Kommission. Darum sind der Druck dieser zwei Institutionen äußerst notwendig.

Rumänien verletzt das Europäische Übereinkommen zum Schutz von Heimtieren welches von Rumänien im 2004 ratifiziert wurde, und zwar den Artikel 13 – Ausnahmen für das Fangen, Halten und Töten – „Ausnahmen von den in diesem Übereinkommen niedergelegten Grundsätzen für das Fangen, Halten und Töten streunender Tiere können nur gemacht werden, wenn sie im Rahmen staatlicher Programme zur Bekämpfung von Krankheiten unvermeidbar sind“. In diesem Sinn kann jeder Bürger der EU ein Schreiben AN DIE KOMMISSION DER EUROPÄISCHEN GEMEINSCHAFTEN WEGEN NICHTBEACHTUNG DES GEMEINSCHAFTSRECHTS betreff der Nichterfüllung seitens Rumäniens der Verpflichtung der Respektierung des Gemeinschaftsrechts, also der Konvention (das Formular kann in jeder gewünschten Sprache heruntergeladen werden, hier: http://ec.europa.eu/eu_law/yuor_rights/yuor_rights_forms_en.htm) richten.

Law 258/2013 regarding the mass euthanasia of the dogs is against the provisions of the European Convention ratified by Romania, it clearly contradicts the European norms regarding animal protection, it is contrary to all the conclusions of the studies performed by specialized institutions as the World Health Organization (WHO) that concluded that dog slaughter has no result on the dog population in the street, it is contrary to all conclusions and results deriving from the mass euthanasia and killings in Romania, it is contrary to all results obtained in Oradea, Lugoj, Cernavoda and in other countries where “catch, neuter and return” lead to the almost complete eradication of the strays situation.

The law regarding the mass euthanasia destroys morality, human dignity, it gravely affects the physical and psychological welfare of the society and it denies the constitutional right to physical and psychological integrity.

We ask the President, the Government, the Sanitary Veterinary National Authority, the City Halls to show morality, wisdom and common sense and to prevent the implementation of a monstrous law, not dignified for the present century and which will not lead to the resolving of the problem.

We ask the European Commission, European Parliament to have a decisive and strong position and to make use of any legislative possibilities in order to stop the massacre of the dogs in Romania.

In case the authorities in Romania persist in abusing their power like the Constitutional Court has done by adopting a decision contrary to its previous decision, persist in pursuing reprehensible decisions, persist in demonstrating brutal and immoral behavior, continue to apply aggressive and corrupt actions, all part of a program for implementing a horrible massacre and which is in contradiction with the civilization degree which Europe has reached, WE REQUEST THAT ROMANIA IS EXCLUDED FROM THE EUROPEAN UNION!

We would like to thank you most sincerely for signing our petition for Romania's homeless dogs.On 25th of September, Romania's Constitutional Court will debate PL912 and decide over life and death of ALL homeless animals in Romania.Depending on their decision, ALL will have to pay with their life. ALL! ... the gentle ones, the pregnant bitches, the puppies, the sterilized ones, the social ones, the community dogs who have never hurt anyone - none will be spared!
ALL will be sentenced to death after 14 days spend in Romania's death camps, if not adopted or perished of thirst and hunger before the 14 days have elapsed.Former senator Marius Marinescu, current President of the Federation for the Protection of Animals and the Environment (FPAM) has challenged the approved law before the Romanian Constitutional Court, and OFA has created a petition in support of Mr Marisnescu's appeal.In an non-corrupted country it would be absolutely normal and predictable that the Court will maintain its position stated in the Decision taken in January 2012. in accordance with art. 77 paragraph (2) of the Constitution of the Romanian Parliament a request for review of the Law on amending and supplementing Government Emergency Ordinance no. 155/2001 on approval of the management of stray dogs.

1. Technique legislative breaches on 10/09/2013, Legal, Discipline and Immunities and Public Administration , Territorial Planning and Ecological Balance filed Permanent Bureau of the Chamber of Deputies, Joint Report on the request for review of the Law on amending and supplementing Ordinance emergency Government Ordinance no. 155/2001 on approval of the management of stray dogs following the decision of the Constitutional Court no. 1/11.01.2012 sent to the Commission for Public Administration Territorial Planning and Ecological Balance and the Legal, discipline and immunities to review, on 18/03/2013.

Ab initio, please note that the two commissions had time to reach you, consider that sufficient and reasonable (about 6 months) for the preparation and submission of the Joint Report.

However, we are aware that the Report is subject to criticism, being superficially prepared, in haste, under the pressure of time and on purpose omitting issues of law and fact, known to members of the Chamber of Deputies which could influence their vote or content of the allowed amendments.

The Legislation knows two great moments:

a) The establishment of social situations which require legal regulation
b) The separation of legal ideal should apply these statements depending on a company's legal consciousness.

Legislative action involves changing trend, innovation of new normative legal solutions, rated as superior as or better than existing regulatory solutions.

Action regulation is subject to strict discipline as do the legislative procedure, the Parliament being held inter alia to respect the Constitution and the decisions of the Constitutional Court of Romania.

To think and act otherwise is to accept abuse, chaos and lack of accountability of the legislative process and pernicious influence on Romanian society and the Romanian state. In culpably, the joint committee of the two major theses in recitals hides Constitutional Court Decision no. 1/11.01.2012 mandatory both in terms of device and accounting considerations and the legal and factual basis for these two committees have submitted Joint Report of the Standing Bureau of the Chamber of Deputies.

Thus, although the findings are cited in the report of the Constitutional Court:

“... the Constitutional Court finds that the wording of Art. 1 section 8 of the law does not meet the requirements of foreseeability required by art. 1 paragraph 5 of the Constitution of Romania, republished. The Court notes that the text of art. 1 section 8 of the Act sets out the proposed solutions regarding the obligation of public authorities to tackle the stray dogs without regard for the order to be applied so that the public authorities responsible for applying the much criticized law will be put in a position to randomly choose one or more of these. However, the proposed solutions of an act can not be applied randomly, the legislature is required to establish the conditions, methods and application of clear criteria and objectives. Thus, based on the much criticized law, the Court noted that the Legislature should establish a priority order on these solutions and the solution euthanizing stray dogs to be applied only as a last resort and only when all other solutions have been consistently applied by local authorities, but have not reached to limit or eradicate this phenomenon - of the importance of providing the order of application of legislative measures, see Decision no. 536 of 28 April 2011, published in Official Gazette of Romania, Part I, no. 482 of 7 July 2011" are omitted other equally important sentence: "Human dignity, from a constitutional point of view, involves two inherent dimensions, namely the relationships between people, which targets the right and duty of the people to be respected and accordingly, to respect fundamental rights and freedoms of their peers (see, to that effect, and Decision no. 62/18.01.2007, published in the Official Gazette of Romania, Part I, no. 104 of 12.02.2007) and the human relationship with the environment, including the animal world, which implies, for the animals, man's moral responsibility to care for these creatures in a way to illustrate the nature of civilization achieved."

In this way the proposed and approved amendments but also the spirit and the essence of the law were flawed.

The Constitutional Court states that the euthanasia of stray dogs should be applied only as a last resort and only when all other solutions have been consistently applied by local authorities but have not reached to limit or eradicate this phenomenon (to observe and Decision 536/28.04.2011 of the CFR).

We question the Joint Report due to the absence therein of:

Ascertaining proper application / inappropriate alternative solutions among which the most important is the sterilization of stray dogs by local authorities;
Reasons for the improper application of alternative solutions, in terms of justifying the necessity of applying since the beginning of the "final solution"

This Joint Report should have included the amendments allowed for the purposes mentioned above. This omission was intended to protect those involved, responsible and decision makers in local government who have been unable or unwilling for illicit reasons to solve the problem of stray dogs using the legislative framework at hand until the occurrence of the tragic event in September 2013.

There is a preliminary assessment of the impact of proposed legislative changes through amendments to the Romanian society. The only "assessment" was made through the statements of leaders, opinion formers and politicians, transmitted in society and media channels and the deeply unserious idea appeared which stated that the only solution is killing all the dogs as the only solution.

A large amount of people disagree this monstrous idea and are being mocked. In relation to this last category of people among which we count ourselves, we want to show that the law itself, the solutions adopted, produce us a deep sadness.

We believe the law to be promulgated in this form violates human dignity, because the legislature will actually target the mass killing of stray dogs. This explains the different and changing period in which they can be accommodated in shelters, from 30 days to 14 days (art. 4 of the Act) and the ambiguity of formalities that must be met, versus a real opportunity to save their lives. The period of 14 working days is insufficient for evaluating, medical sterilization, control and possibly medical treatment, vaccination, deworming, immunization, micro chipping, knowing that a dog which did not go through these phases can not be given for adoption. Moreover, in the same period, the adopter must prepare necessary documentation (proof of space that results in appropriate conditions for growth and housing of dogs, financial resources for the raising and maintenance of dogs, owners’ or shareholders’ agreement with backyard neighbours, adoption fee-which amount is not known until now). Also, in the same period, the adopter must be effective and create conditions that can not take formal notice of the existence of the dog offered for adoption, its characteristics and the time remaining until his murder.

We conclude that Parliament did not want to take responsibility to use appropriate terms.

Thus, although euthanasia is a method for suppression of life, medical assistance and that sole noble purpose of the subject of further protecting the suffering caused by an incurable disease, the term is used by the legislator wrongly, being violated so binding principles defining the concepts that undertake within the proposed legislative solutions to achieve an explicit configuration of concepts and terms used in the new regulations that have another meaning than the common, to ensure their proper understanding and thus avoid misinterpretation (article 25 of Law 24/2000 republished).

The legal document should be written in a language and style, specific legal regulation, concise, sober, clear and precise to exclude any ambiguity, in strict compliance with the rules of grammar and spelling. The specific terms may be used only they refer to the activity mentioned in the regulation.

Excellence, please note that in:

- art. 7 paragraph 2 of the Act: “Unclaimed dogs will be euthanized and not adopted .....“,

- art.7 paragraph 3 of the Act: "The decision for euthanasia is issued for each dog ....”

- Art. 7 paragraph 4 of the Act: "Pending the euthanasia procedure can be claimed or adopted dogs",

the term euthanasia is used in the wrong way and with its wrong significance.

Correctly and according to the will of the Romanian Parliament in place of the term euthanasia, the term murder or killing should be used. As a related fact, to demonstrate that the euthanasia procedure and how the meaning of this term is described in art. 5 of the law, a careful and impartial observer must be comprised by confusion in understanding and applying the provisions of art. 7 of the law.

The Romanian Parliament should consider that as just this once, to take full responsibility for its intentions. If we wanted to euthanize stray dogs then, unequivocally and correctly, the procedure for suppression of life can only target incurably ill dogs. If the legislature intended the disappearance of all stray dogs, the correct term to be used was killing or murdering.

2. Social peace. Respect for human dignity:

According to art.4 ( 1 ) of the Constitution: "The State foundation is based on national unity and solidarity among its Romanian citizens"

According to Art. 4. (2) of the Constitution of Romania: "Romania is the common and indivisible homeland of all its citizens regardless of race, nationality, ethnic origin, language, religion, sex, opinion, political adherence, property or social origin"

Excellence, please respectfully state that:

There are many Romanian citizens who are not convinced that killing all stray dogs is a moral and civilized solution;
There are many citizens of this country who believe that local authorities and the public should respect the obligation to provide correct information to the citizens in public affairs and matters of personal interest (art. 31 paragraph (2) of the Constitution).

Legislative solution adopted without showing reasons which made it impossible to apply alternative methods without showing those responsible for this failure, has divided society and undermined the solidarity that should exist between citizens of the country. We believe you should make an effort on the part of local authorities and public, to convince us that although alternative solutions were applied properly and all involved in the process have acted in good faith and in a professional manner to meet certain standards of life the citizen, there is only the solution. Ignoring the fact that it has never been called into question by the political class, we thoroughly question the existence or absence of a civilized life in Romania.

We can not leave unnoticed the fact that the law to be promulgated enroll in fact in the same note of disregarding the will, aspirations, feelings, emotions of citizens of this country.

We noticed that the activity of "taking" of stray dogs which are on the public domain restarted in force gave way to a recently born satisfaction on the one hand and suffering, on the other.

Moving to another register, dare to take this opportunity to ask the political class as a whole: What explanations does a parent present his child during the capturing of a stray dog, knowing that it will be killed? Probably he will say: “The dog must be killed in order to protect you, the dog can kill you” or he can say: “We live in a country of barbarians and politicians wanted it (this)."

Excellence, your high mission is to identify and use the leverage necessary to reduce as much as possible the shock felt by those who for reasons of education, culture, morality, social status, affection, and relationship with the environment are not prepared to accept the application of such a law, in the form sent for promulgation. The frustration is being reinforced by the lack of liability of policy makers and local government responsible for the present situation.

Excellence, please allow us to conclude, recalling the words of the eminent lawyer and professor Vintilă Dongoroz, which state the following: "A law which asks man not to be human, is absurd and can not be implemented"

Veterinarian with experience in killing dogs in the 2000’s now recovers his job back

After 13 years since the inhabitants of Pitesti have no longer seen dog catchers strangling chained dogs and dragging them along the street pavements, last Monday the people in blue overalls to whom the City Council entrusted the task of capturing the stray dogs of Pitesti already reported their first victim: after chasing a dog until they pushed it under the wheels of a car, they practically let it lie there, in the middle of the street, in full traffic, after he had been hit by a car. The witnesses of this scene promptly asked for the intervention of AULIM, who came and picked the fractured-spine dog, which had been crawling to the edge of the street.


And yet, the victim of this incident was not only the dog broken into halves by the untrained and disinterested dog catchers, but also a human being, as well: a person who could not resist the sight of this scene had to be helped and taken home, where she was provided with medical care.

The Pitesti inhabitants pay out of their own pockets for the illegalities committed by the dog catchers.

If until the present the citizens of Pitesti has not had any financial contribution to the management of stray dogs, once this was something supported from private funds from Germany, now, for the capturing and killing of each stray dog, the Pitesti inhabitants pay out of their own pockets, either they like it or not. Besides, they even pay with their own money for the first illegalities committed.

The car numbered Ag 20 KRM that is used to capture the dogs is not inscriptioned, just like the dogcatchers’ equipments, too, and nobody knows their origin, since, once asked about them, even their users seem not to know where they come from. The car is hermetically closed, has no ventilation, the transport is not made in individual cages, and the tranquilized dogs are piled on one another. The contracting firm of this service has ”managed” to breach the provisions of at least three laws: Government Urgency Ordinance No. 155 on the approval of the stray dogs management programme, as subsequently amended and supplemented, Law no. 205/2004 concerning animals protection, and Council Regulation (EC) 1/2005 on the protection of animals during transport.

Stefan Preda, the veterinarian employed by the Pitesti City Hall before 2001 to kill stray dogs, is now reinstated into his old position after 13 years of ... waiting!

Stefan Preda has been well-known to the animal lovers for his ”diligent” work in the 2000’s, as well as for his quick answer, in 2001, when asked ”How could you kill 2000 dogs?”, when he corrected his interviewer by saying: “I beg your pardon, they were 4000, Madam!”, and accompanied this rectification with a satisfied smile.

Over the 2000’s, the dogs used to be injected with formol or poisoned by strychnine.

Considering how gladly he accepted this killing job of the stray dogs, after only 14 days (as per the operating rules for the public service, as adopted by the Local Council of Pitesti), we wonder whether financial satisfactions are the only ones that Stefan Preda may derive from that.

Twenty-one veterinarians from Pitesti signed an open letter against the euthanasia programme against stray dogs. “We strictly delimit ourselves from any professional fellow who may breach our professional deontological code and principle of morality in this respect”, considering that “any activities of stray dogs slaughter are inglorious and demeaning” and that “we cannot assimilate our profession as veterinarian to that of hired assassins”.

In Pitesti, Romania, mass killing of dogs is preparing! Please, HELP us to STOP!

Dear all,

In 2000 the images of dogs killed in the forest of Pitesti city, loaded in carts and thrown into a ravine terrified the international community. Back then, due to the lack of proper animal protection legislation (which was much later adopted) mistreatment and killings were not prohibited, therefore any animal abuse could have been judged morally at the most, but was not considered illegal.

However we managed to stop all atrocities by handing over the stray dogs management to a German association which founded AULIM, in Romania, and a shelter of 3000 dogs, which I coordinated till 2007, when I withdrawn and focused on national level. During this period, in 2004, we got an official agreement with the municipality for running a sterilization and return program.

So, Pitesti became one of the few cities in Romania where dogs stopped being killed 13 years ago.

Soon the situation will be different. The Municipality Pitesti organised the own Stray Dog Public Service and is preparing to mass kill the dogs neutered and returned in the territory by AULIM and, as well, all the dogs who will continuously refill the teritorry after the neutered ones are eliminated. The killing of dogs will be done right in the new public shelter (built with 530 000 Euros, public money!). Even more cynical is that the Municipality’s shelter is located just 200 m away from the AULIM shelter.

The city Pitesti is among twelve European cities which compete for the title “European Green Capital”, which based on entrants’ environmentally friendly urban management. How “friendly management” can be defined for a town that kills the “environment”?

PLEASE, HELP US TO STOP ANY INITIATIVE OF MASS KILLING THE DOGS IN PITESTI!

Stray dog situation/legislation in Romania-UPDATE (English & Deutsch message)

Dear all,

Implementation of the Norms of the Law 258 have not yet been approved by the Government.
But since many of you asked me for an update including the context in which on December 5 at the Romanian Embassy in Vienna will be the presentation of the Norms, and some of you will be there, I think the most important issues highlighted at the moment are:

1. In developing Norms, animal protection organizations were not consulted. There was only a " hearing" for their opinions but without the inclusion of the proposed amendments.

2. The Norms do not change the 14 day period before euthanasia !

3. Although despite these Norms there would not be a possibility of capturing neutered, gentle, peaceful dogs, cared for by citizens, this will not happen and all dogs will be captured. The only exception are those who are in enclosed spaces, which otherwise do not exist since it is forbidden to build pens in addition to blocks !

4. The law requires the sterilization of dogs with owners, a good thing to provide but the absence of other provisions will lead to a disaster because:

§ In Romania there are at least 5 million dogs‘ owned‘ dogs ! It is impossible to sterilize all dogs within 12 months - there are not enough doctors who have offices and who knows how to sterilize

§ Many doctors who can not sterilize, will commit to do so, and the result is often ther death of females. For example, Curtea de Arges, all females (about 500 ) " sterilized " by a doctor hired by the mayor, died after days of agony in the streets. We filed a criminal complaint and I complained to the Ethics Committee of the College of Veterinarians but as it unfolds, despite all declarations, medical certificates from other veterinarians, samples, pictures, videos, it seems that the doctor is "not guilty " and will continue to kill dogs by sterilization

§ The Norms do not provide any financial support from the government for the sterilization of dogs. There are minimum of 4 million owned‘ dogs in rural areas where people do not have the financial possibilities and where the dog in the yard is not regarded as important, for which to prevent fine, most dogs will be abandoned in bags tied to trees in forests, thrown into disused wells, into streams, as is the ancient practice of those who become useless.

Authorities initiate propaganda to try to manipulate the population into believing that the law 258 is the "Law of Adoption " and NOT a " Killing Law ". In reality :

§ Dozens of people stand at the gates of shelters to adopt dogs captured from the street but they are not allowed to adopt
§ The law provides that if you adopt more than two dogs, you must have the permission of a tenants association and neighbors
§ Houses of animal lovers are already full of dogs rescued from the streets, and cannot absorb hundreds of thousands of dogs from the street
§ Some mayors harass people who have animals in the house, going over them and giving them fines on behalf of local decisions and you can not keep your pet without the consent of neighbors and anyway you can not have more than two pets

Who does not sterilize their dog within 12 months will pay a fine of up to 2,500 euros (net average salary in Romania is 350 Euro! ).

Authorities deliberately suggest that the animal lovers have responsibility for the euthanasia of dogs which have not been adopted in the requisite 14 days ! This will seek to place responsibility for the euthanization onto animal lovers because the dogs were not adopted !

Pitesti: people who feed the stray dogs PUNISHED by the Mayor

Dear all,

After making interventions in Parliament to vote on euthanasia , the Mayor of Pitesti, Mr. Tudor Pendiuc, violates individual freedom , ethical rules , steps over feelings of compassion which are usual in a normal society , defies any human feelings and initiates a draft decision of the local council which has one item :

It prohibits the construction of shelters and animal feeding inside housing blocks , the green spaces around the blocks of flats or in any place in the public domain .

HCL project makes provision to fine people who feed dogs, cats!

In the mind of the Mayor, feeding the animals is not good behaviour and is therefore discouraged. . Is such an act not " worthy " of being regarded as contrary to common sense and inconsistent with being a civilized society , as images of skeletal dogs on public land will now become a world image exemplifying how " civilized and compassionate " is Pitesti! This project will vote next week !

Please send very short PROTESTS notes against this project by which people feeding dogs, will be punished or fined and against the Mayor's management of dogs by capturing all dogs, neutered or not, which are protected by the population, for the sole purpose of killing them.

Pitesti: people who feed the stray dogs PUNISHED by the Mayor

Dear all,

After making interventions in Parliament to vote on euthanasia , the Mayor of Pitesti, Mr. Tudor Pendiuc, violates individual freedom , ethical rules , steps over feelings of compassion which are usual in a normal society , defies any human feelings and initiates a draft decision of the local council which has one item :

It prohibits the construction of shelters and animal feeding inside housing blocks , the green spaces around the blocks of flats or in any place in the public domain .

HCL project makes provision to fine people who feed dogs, cats!

In the mind of the Mayor, feeding the animals is not good behaviour and is therefore discouraged. . Is such an act not " worthy " of being regarded as contrary to common sense and inconsistent with being a civilized society , as images of skeletal dogs on public land will now become a world image exemplifying how " civilized and compassionate " is Pitesti! This project will vote next week !

Please send very short PROTESTS notes against this project by which people feeding dogs, will be punished or fined and against the Mayor's management of dogs by capturing all dogs, neutered or not, which are protected by the population, for the sole purpose of killing them.

Stray dog situation/legislation in Romania-UPDATE (English & Deutsch message)

Dear all,

Implementation of the Norms of the Law 258 have not yet been approved by the Government.
But since many of you asked me for an update including the context in which on December 5 at the Romanian Embassy in Vienna will be the presentation of the Norms, and some of you will be there, I think the most important issues highlighted at the moment are:

1. In developing Norms, animal protection organizations were not consulted. There was only a " hearing" for their opinions but without the inclusion of the proposed amendments.

2. The Norms do not change the 14 day period before euthanasia !

3. Although despite these Norms there would not be a possibility of capturing neutered, gentle, peaceful dogs, cared for by citizens, this will not happen and all dogs will be captured. The only exception are those who are in enclosed spaces, which otherwise do not exist since it is forbidden to build pens in addition to blocks !

4. The law requires the sterilization of dogs with owners, a good thing to provide but the absence of other provisions will lead to a disaster because:

§ In Romania there are at least 5 million dogs‘ owned‘ dogs ! It is impossible to sterilize all dogs within 12 months - there are not enough doctors who have offices and who knows how to sterilize

§ Many doctors who can not sterilize, will commit to do so, and the result is often ther death of females. For example, Curtea de Arges, all females (about 500 ) " sterilized " by a doctor hired by the mayor, died after days of agony in the streets. We filed a criminal complaint and I complained to the Ethics Committee of the College of Veterinarians but as it unfolds, despite all declarations, medical certificates from other veterinarians, samples, pictures, videos, it seems that the doctor is "not guilty " and will continue to kill dogs by sterilization

§ The Norms do not provide any financial support from the government for the sterilization of dogs. There are minimum of 4 million owned‘ dogs in rural areas where people do not have the financial possibilities and where the dog in the yard is not regarded as important, for which to prevent fine, most dogs will be abandoned in bags tied to trees in forests, thrown into disused wells, into streams, as is the ancient practice of those who become useless.

Authorities initiate propaganda to try to manipulate the population into believing that the law 258 is the "Law of Adoption " and NOT a " Killing Law ". In reality :

§ Dozens of people stand at the gates of shelters to adopt dogs captured from the street but they are not allowed to adopt
§ The law provides that if you adopt more than two dogs, you must have the permission of a tenants association and neighbors
§ Houses of animal lovers are already full of dogs rescued from the streets, and cannot absorb hundreds of thousands of dogs from the street
§ Some mayors harass people who have animals in the house, going over them and giving them fines on behalf of local decisions and you can not keep your pet without the consent of neighbors and anyway you can not have more than two pets

Who does not sterilize their dog within 12 months will pay a fine of up to 2,500 euros (net average salary in Romania is 350 Euro! ).

Authorities deliberately suggest that the animal lovers have responsibility for the euthanasia of dogs which have not been adopted in the requisite 14 days ! This will seek to place responsibility for the euthanization onto animal lovers because the dogs were not adopted !

Letter to European Council -stray dog Romania - request to co-sign the letter!

Dear all,

I address the email to all of you who have an association/foundation/federation in Europe (for animal welfare, environment protection and even human rights).

Attached there is a LETTER that proposes a solution under EU law to the situation of dogs in Romania (but as well in other countries having the same stray dog situation)
The letter is drafted by lawyers (in collaboration with stray dog management experts) and it will be sent to the European Commission.

Thousands and thousands abandoned dogs: abused, beaten, poisoned, giving birth to unwanted puppies, silently suffering on the streets of Romania. We all know the solution to end this problem: setting up national wide sterilization program, sustained from the public governmental funds, in collaboration with experienced vets from each region of Romania.   
Only one charity is not wealthy enough to afford sterilizing all the animals from a region of Romania. Due to lack of people education, some hide their dogs from being sterilized while others abandon the puppies on empty fields, throw them in trash bins or over the shelter' fencing, etc A constant number of un-sterilized animals give birth to puppies that grow to the age when they can produce themselves a new generation of street dogs.   
We all heard of the massive corruption in Romania. The lack of authorities' humane reaction regarding the strays' overpopulation in the last 25 years is not accidental. The financial benefits could be one of this lacks of reaction, which continued even when international personalities like Brigitte Bardot wanted to put own money into solving the problem humanely, decently – by sterilizing all the strays of Bucharest e.g. Being exposed to the public, international opinion the dogs slaughtering decreased.   
ROLDA works with two local veterinaries to sterilize and treat our rescued dogs. Considering that Galati' strays problem requires massive funding and the sincere cooperation from the authorities' side, plus enormous logistic efforts – to organize a successful sterilization campaign that will show results, we aim to provide free sterilizations for the dogs caught at the outskirt of the town, in the industrial sites, in Smardan village (where ROLDA signed a protocol with the Mayor that protect the sterilized and ear tag dogs from being catch and killed)   
Considering that both ROLDA shelters are in the vicinity of Smardan (the large shelter) and inside the village of Smardan (the Adoption Center), we also think we "owe" to the local people to help them sterilize their own pets and dogs roaming around because they show understanding when dogs disturbed often barking during their relaxation time or during nights.   
After hoping for years that we can do something for the entire region of Galati, we revised the whole plan. We are extremely grateful that the sterilizations costs are covered by the steel plant for the dogs catch from their premises.   We hope to raise funds to sterilize the approx 1800 dogs from the outskirt of Galati and Smardan village. 
In the first phase, we want to sterilize 200 dogs and document this action with photos to all our donors and the public. We remind you that each sterilization costs 20 US$. We aim to raise 4000 $.

This is an emergcency and a horrible situationDue to a tragic incident in Bucharest ) where a 4 years old child died because of the wounds inflicetd by some dogs ( who were living on a partially deserted construction site, beloging to a developper SR LAGUNA TEI ) because both the victim and his 6 years old brother have been left UNSUPERVISED for more than 20 minutes by their Grandmother while out in a park, now the MEDIA and those who preach the mass killing pf stray dogs, have started one of the MOST HORRIBLE campaing against these poor animals who still are and continue to appear on the streets of Romania, because local authorities NEVER took the right measure - impose mas sterilization and severely punish the abandon...
President of Romanian Traian Basescu asked the government to immediately prepare an Emergency Ordinance which will esteblish a certain period of time for stray dogs to be adopted by animal lovers, taken home and kept in their own yard, and the remaining ones to be euthanised." I make an appeal to the Government, - because the local administration have their hands tied by the present legislation - to issue an Emergency Ordinance which will porovide a certain period of time for stray dogs to be adopted by animal lovesr, taken home and kept in their yards, and those who are not adopted to be euthanised" 
The President also said that the sterilization of dogs, prolongues their lives up to 12-15-18 years. " The sterilization is a longterm solution, which prooved unsuccessful".Based on his estimation the sterilizatuion and care for the dogs did not give results. I ask from the bottom of my heart everyone who sustain life to protest against this barbaric decision. Romania must be punished hard for this immoral decision! In Pitesti, Romania, mass killing of dogs is preparing! Please, HELP us to STOP! Back then, due to the lack of proper animal protection legislation (which was much later adopted) mistreatment and killings were not prohibited, therefore any animal abuse could have been judged morally at the most, but was not considered illegal. However we managed to stop all atrocities by handing over the stray dogs management to a German association which founded AULIM, in Romania, and a shelter of 3000 dogs, which I coordinated till 2007, when I withdrawn and focused on national level. During this period, in 2004, we got an official agreement with the municipality for running a sterilization and return program. So, Pitesti became one of the few cities in Romania where dogs stopped being killed 13 years ago. Soon the situation will be different. The Municipality Pitesti organised the own Stray Dog Public Service and is preparing to mass kill the dogs neutered and returned in the territory by AULIM and, as well, all the dogs who will continuously refill the teritorry after the neutered ones are eliminated. The killing of dogs will be done right in the new public shelter (built with 530 000 Euros, public money!). Even more cynical is that the Municipality’s shelter is located just 200 m away from the AULIM shelter. The city Pitesti is among twelve European cities which compete for the title “European Green Capital”, which based on entrants’ environmentally friendly urban management. How “friendly management” can be defined for a town that kills the “environment”? PLEASE, HELP US TO STOP ANY INITIATIVE OF MASS KILLING THE DOGS IN PITESTI! Wegen mangelnder Gesetzgebung zum Tierschutz (welche später eingeführt wurde) waren Mishandlung und Tötung von Hunden nicht verboten, und Missbrauch von Tieren wurde nicht als illegal angesehen und konnte bestenfalls moralisch verurteilt werden. Wir konnten jedoch alle weiteren Schreckenstaten vermeiden, indem wir das Management von Strassenhunden an eine deutsche Gesellschaft übergaben, die AULIM in Rumänien gründeten. Ausserdem wurde ein Tierheim für 3000 Hunde geschaffen, das ich bis 2007 koordinierte. Seitdem bin ich auf nationaler Ebene aktiv. In 2004 erreichten wir eine Vereinbarung mit der Stadtverwaltung für ein Kastrations - und Freisetzungs- Programm. Damit wurde Pitesti vor 13 Jahren einige der wenigen Städte in Rumänien, wo Hunde nicht mehr getötet wurden. Diese Situation wird sich bald ändern. Die Stadtverwaltung von Pitesti hat ihren eigenen öffentlichen Streuner-Hund Dienst eingerichtet und bereitet sich zur Massen-Tötung von den Hunden, die durch AULIM sterilisiert und freigesetzt wurden, vor, sowohl von allen Hunden, die sich weiter verbreiten werden, nachdem die sterilisierten Hunde vernichtet worden sind. Die Hunde werden in dem neuen öffentlichen Tierheim getötet, das mit 530.000 Euros von öffentlichen Geldern gebaut wurde. Noch zynischer ist es, dass das Tierheim der Stadtverwaltung nur 200 m von dem AULIM Heim entfernt ist. Die Stadt Pitesti ist eine von zwölf europäischen Städten, die sich um den Titel "Europäische grüne Hauptstadt" bewerben, ein Titel, der auf Grund von Umwelt-freundlicher Stadtplanung bewertet wird. Although NGOs and citizens continuously requested the implementation of sterilization programs for all dogs with owners, you did not act in this direction and thus you allowed thousands of dogs to be abandoned leading to the continuous dog refill of the city streets. Your attitude seems ungrateful towards the money and the tremendous efforts of the EU member states citizens, especially Germany, which invested millions of Euros in your city and made Pitesti well known at international level. It is unacceptable that instead of trying to involve the animal welfare organizations in the process and implement Oradea/Romania model, you've decided to destroy 13 years of work and achievements performed with the money of moral, compassionate and civilized European citizens. It is equally unacceptable to promote misleading information regarding the ''growing'' number of dogs in the street, or regarding the number of people bitten by stray dogs, or the ‘’hundreds’’ of complaints. The reality is different since we are flooded with protests of citizens from Pitesti against the abusive killings of dogs in Pitesti. If you start killing dogs and considering that this attitude is a great offend to European Union citizens who have invested in sterilizations, treatments, international adoptions, building and maintenance the largest dog shelter in the world, we reserve the right to inform all relevant international institutions. OUTRAGEOUS : Authorities in Bucharest have opened a PUBLIC shelter in a penitenciary - restrict public access Dw The Bucharest City Hall ( General Mayor Sorin Oprescu ) and ASPA ( the Bucharest Authority for the Surveillance and the Protection of Animals ( led by Razvan Bancescu and Bogdan Treeroiu ) have decided to open IN SECRET, a new shelter for stray dogs on the GROUNDS of the Penitenciary Rahova in the Commune Bragadiru - Ilfov County Romania . They transport IN SECRET, in unmarked trucks, even more than 80 dogs at one time, and they leave them in the care of INMATES. Everything has been documented and appealed to National Authorities, by Vier Pfoten Foundation - Bucharest - All the information is in the petition. PLEASE SIGN and share far and wide...this is beyond unbelievable that in a STATE of LAW - local authorities, mayors, re-write the law as they wish, WITH IMPUNITY.
